Limitation of Liability – Nema-7.com
Nema-7.com is a division of Product Recovery Management, Inc. (PRM), a North Carolina corporation located in Durham County, North Carolina. By purchasing products from Nema-7.com or any PRM-affiliated entity (including PRM Filtration, Spartox, Falco, or others), the buyer agrees to the following terms.

Jurisdiction and Legal Proceedings:
The buyer acknowledges and agrees that any and all legal actions, disputes, claims, or proceedings arising from the purchase or use of products sold by PRM, whether from our online platforms or direct purchases, shall be governed by the laws of the State of North Carolina. Any such actions must be brought exclusively in State Court of North Carolina, located in Durham County, North Carolina. The buyer consents to the jurisdiction of the state courts located in Durham County, North Carolina, and agrees that such venue is proper and convenient for the resolution of any disputes.

Legal Fees:
In the event of any legal action, mediation, or arbitration arising from a dispute between PRM and the buyer, the parties agree that the prevailing party in such proceedings, whether in court, mediation, or arbitration, the buyer will be entitled to recover all legal costs and attorney fees incurred by the prevailing party against the non-prevailing party. This includes any and all expenses related to the defense or prosecution of the claim.

Dispute Resolution:
Before engaging in formal litigation, both parties agree to attempt to resolve disputes through mediation or arbitration. However, if a resolution is not reached through these means, the buyer agrees that any subsequent legal proceedings shall be conducted in the North Carolina State Court located in Durham County, North Carolina, as stated above.

Buyer Responsibility and Compliance:
As previously stated, PRM is not responsible for the engineering, design, or installation of any products sold. The buyer assumes full responsibility for ensuring that all purchases meet their intended needs and comply with relevant safety, engineering, and regulatory standards. All products must be installed by a Licensed Electrical Contractor, and it is the buyer’s responsibility to ensure compliance with local permitting and inspections.

Performance and Liability:
PRM makes no warranties, express or implied, unless specifically documented as a “Performance Guarantee.” The buyer assumes all risks associated with the purchase, installation, and use of the equipment, and PRM shall not be held liable for any damages resulting from improper product use or installation.
ALL IMPLIED WARRANTIES OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED.

Conclusion:
By purchasing from Nema-7.com or any PRM-related entity, the buyer agrees to the terms of this Limitation of Liability.
